1. You have to request a driver’s license hearing within 10 days of getting cited for DUI if you want to keep your license.
2. Your driving privilege will be suspended in Utah even if you don’t have a Utah driver’s license.
3. A suspension for DUI in Utah will suspend your driving privilege in most other states as well.
4. You have the right to remain silent. You don’t have to answer the officer’s questions.
5. The penalties for a DUI vary widely in Utah.
Depending on the circumstances of your case and your lawyer’s experience, you may have to go to jail or just do community service. You may have to have a probation officer or not. You may be ordered to install an ignition interlock device or not. DUIs have far-reaching consequences. It makes sense to hire a lawyer who can help you minimize the penalties.
6. The police have to have a good reason to pull you over. If they don’t, the whole case could get dismissed.
7. The breath machine is not perfect. Like all machines, it can make mistakes. Just because a machine says your breath alcohol level was high does not automatically mean you are guilty.
8. If you get more than one DUI, each new DUI is much more serious and is punished more severely.
9. Utah officers often use two breath tests: a portable breath test that is not usually usable in court and the intoxilyzer machine which usually can be used in court.
10. If you win your driver’s license hearing, you can get $330 back from your impound fees.
